General Terms and Conditions

General Terms and Conditions for deliveries to a client of orders placed through www.dekralendoos.nl   Article 1 General 1.1 These General Terms and Conditions are applicable to all offers of The Beadsdoos and to all agreements with The Beadsdoos in so far as we have not deviated in writing from these general terms and conditions. 1.2 Should a client refer to his/her conditions, these conditions will not be applicable unless The Beadsdoos has agreed to this in writing. 1.3 Deviation from the general terms and conditions is only possible when this is done in writing and in such case the remaining general terms and conditions will be applicable. 1.4 By accepting a special offer or placing an order the client accepts our general terms and conditions. 1.5 A client is any visitor of our internet site or any natural person or legal identity who has entered a contract relation of any nature. 1.6 The Beadsdoos reserves the right to change or expand these general terms and conditions. 1.7   A client accepts our general terms and conditions and all other obligations that are mentioned on our internet site by using our internet site and/or placing an order with us. 1.8 The Beadsdoos is authorised to avail of third parties in implementing this agreement with the client. These general terms and conditions are in such a case applicable. Article 2 Offers 2.1 Alle All offers made by The Beadsdoos are without obligation and as long as they are in stock. 2.2 The Beadsdoos reserves the right to changes prices, especially when that is necessary according to legal regulations. 2.3 An agreement is effective when an order confirmation has been sent to the e-mail address supplied by the client confirming the order that has been made by the client. The client and The Beadsdoos specifically agree that agreements made using any electronic form of communication is a valid agreement as soon as the order confirmation has been sent to the client. The electronic data base of The Beadsdoos is valid for this purpose, as far as this is allowed by the law. 2.4 Information, images and announcements made either by mouth, per telephone or through e-mail regarding all offers and the most important characteristics of our products are given as accurately as possibly. The Beadsdoos can not guarantee that all offers and products comply completely with the given information. Deviations from these descriptions can not result in a claim for damages or dissolving the agreement. Article 3, Delivery and Transport 3.1 The Beadsdoos has most of the articles in stock. Orders will be delivered as quickly as possible. Orders that have been prepaid are generally sent within three working days after receipt of the payment. Orders made under the condition C.O.D. (cash on delivery) are generally sent within three working days after receipt of the order. The afore mentioned delivery times are indications and can not be definite. A client is not entitled to any damages or the right to cancel an order or dissolve the agreement when the delivery takes longer than the afore mentioned delivery times unless the delivery time will take so long that it be expected from the client to wait for the products. In that case the client is justified in cancelling the order in as far as this is necessary. Any monies paid for this product will then be transferred to the client’s bank account. 3.2 A client ordering a product that is temporarily out of stock will be notified when the product is once again deliverable. The client will be notified by e-mail of telephone of any delays. 3.3 Delivery will be made to the address given by the client. Deliveries abroad can be subject to different terms. 3.4 Delivery times can be different for deliveries abroad. 3.5 The Beadsdoos can not be held responsible for any mistakes made by TNT Post in deliveries. Article 4 Ownership 4.1 The Beadsdoos remains owner of all products until such time as the amount due for these products has been received by The Beadsdoos. Any risk involving the (ordered) products will be applicable from such time as that the order has been sent to the address given by the client by The Beadsdoos. If the client is not available to receive the delivery any costs involved are to be paid by the client. Any deliveries that will be returned are also to be paid by the client and accompanied by a written explanation of the reason that the goods are being returned. Article 5 Prices and payments 5.1 All prices stated by The Beadsdoos are in Euro's, including turnover tax and excluding postage and administration costs unless otherwise mentioned or agreed. 5.2 All post and administration costs are stated on our internet site. There are deviant conditions for delivery and costs with respect to other methods of payment.   5.3 Special offers are only available for the period stated on the internet site regarding the special offer. 5.4 Special offers will not automatically be effected with later orders. 5.5 Special offers will not automatically be effected with later orders. 5.6 Orders made through our internet site can be paid by:? ·        Advance Payment: the client transfers the amount due including postage and administration and any costs due for extra services to our bank account number 10.50.90.425 with the Rabobank Nunspeet, making reference to the order date and number. ·        C.O.D. (Cash on Delivery): the client pays in cash or a method chosen by the courier the amount due (including postage and administration and c.o.d. charges) to the courier. Article 6 Changing and cancellations 6.1 The client is obliged to closely examine the products upon delivery and confirm that the delivery meets the order made by the client. The client must take into account a small degree of colour differences to the products shown on the internet site. Should the delivered goods not meet the agreement then the client should inform The Beadsdoos as soon as possible of this but not later than seven working days after receipt of the products, in writing or by e-mail, giving an explanation. 6.2 The Beadsdoos will replace the products or repay the amount paid if it is proven that the products do not meet the agreement. 6.3 If you want to purchase a product for any reason, you are entitled to return the product within seven working days after receipt of the delivery to The Beadsdoos. Returned goods will only be accepted if they are returned in the original state and not damaged or used. 6.4 If the client exercises his/her right in the article as stated in 6.3 The Beadsdoos will return the funds due to the client within 14 days. 6.5 Costs for returning goods are to be paid by the client. Article 7 Guarantee and Liability/span> 7.1 The Beadsdoos gives a factory guarantee for the bought articles. This guarantee does not apply to goods that have endured wear and tear that can be considered normal and in the following cases: inexpert use, deliberate or obvious carelessness, water damage, freezing or filthiness 7.2 The Beadsdoos is never obliged to reimburse any compensation through payment or any other means to the client or others unless it is a case of deliberate or obvious carelessness from The Beadsdoos. The Beadsdoos is never liable for company damage, damage caused indirectly, profit or loss of turnover. Should The Beadsdoos be obliged, for any reason, to make restitution, the restitution will never exceed the amount on the invoice regarding the product or service for which the damage has been caused. 7.3 It is possible that The Beadsdoos places links on her site that refer to other internet sites that could be interesting or supply information that could be useful for the visitor. Such links are purely informative. The Beadsdoos is not responsible for the content of the internet site to which we have referred or use of the internet site.   Circumstances beyond our control 8.1 When circumstances are beyond our control The Beadsdoos is not obliged to fulfil her duties towards the client, respectively the obligation will be suspended for the length of time that the circumstances are beyond our control. 8.2 When referring to circumstances beyond our control we mean any circumstances or activities of which we have no control and by which we cannot meet our obligations towards the client. Under these circumstances are: strikes, fires, company interruptions, energy interruptions, not or not on time delivery from suppliers or any other third parties who have been contracted to supply or deliver and in the absence of the necessary permits from the Government. We also consider circumstances beyond our control to be interruptions in the (telecommunication-) network or connections to communication systems and or unavailability of the internet site at any given moment. 9 Article 9 Intellectual Property 9.1 The client recognises specifically that all rights of intellectual property of any information given, images, announcements or any other statements regarding the products or internet site lies with The Beadsdoos, her suppliers or other rightful owners. 9.2 We consider intellectual property to be any patent-, authors-, brand-, drawings- and model rights and/or any such rights, under which are all not patented technical and or commercial methods and concepts.         9.3 The client is forbidden to use, even after changing the concept, any of the intellectual properties as described in this article, such as multiplication, without expressly having received permission from The Beadsdoos, her suppliers or other rightful owners unless it is expressly used for private use in relation to the product. Artikel 10 Privacy cliënt 10.1 10.1 Personal details supplied by the client will be handled confidentially and will only be used for the following purposes: ·        Processing the order, the payment and delivery of the order to the address supplied by the client; ·        Improving the client friendliness of our website ·        Enable us to compile special offers and supply relevant information or news letters. 10.2 When using personal details supplied by the client The Beadsdoos will respect the privacy rules and civil laws 10.3 The Beadsdoos will not give any personal details of clients to third parties. Article 11 Legal jurisdiction 11.1        Dutch Civil Law is applicable for each agreement made between The Beadsdoos and the client. Application of the Vienna Agreement is specifically ruled out. 11.3 Any differences between parties will be brought to the authorised judge in The Netherlands. 12 Article 12 Sundries 12.1 The Beadsdoos is situated in Nunspeet, and registered with the Chamber of Commerce, registration number is 08127171. The V.A.T.-identification number is NL.8151.18.284.B01. 12.2 Please send all correspondence to: The Beadsdoos, Troelstrastraat 42, 8072AN in Nunspeet, or to the e-mail address that you will find on our internet site. 12.3 Permission (silent or otherwise) from The Beadsdoos to deviate, for a short or longer period of time, from these General Terms and Conditions does not mean that The Beadsdoos can not exercise her legal right to implement these General Terms and Conditions. The client is not entitled to any legal rights because of flexibility shown by The Beadsdoos upon implementation these General Terms and Conditions.
